1. Agreement to Terms
By accessing or using Prevara (“Service”), operated by Prevara LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is available at prevara.io and any associated subdomains.
2. Description of Service
Prevara is a subcontracting intelligence platform that provides federal and state procurement data, prime contractor analytics, opportunity alerts, and compliance insights to certified small businesses and prime contractors. Data is sourced from publicly available government databases including SAM.gov, USAspending.gov, and state procurement portals.
3. Account Registration
You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must notify us immediately of any unauthorized use. Accounts are limited to one concurrent session per subscriber.
4. Subscriptions and Billing
Paid subscriptions are billed monthly in advance through Stripe. All plans include a 7-day free trial. You may cancel at any time through the billing portal; cancellation takes effect at the end of the current billing period. No refunds are provided for partial months. We reserve the right to change pricing with 30 days written notice. Plan upgrades are prorated immediately. Plan downgrades take effect at the next billing cycle.
5. Acceptable Use
You agree not to:
Share account credentials or allow multiple users to access a single account. Scrape, crawl, or systematically download data from the Service. Resell, redistribute, or sublicense data obtained through the Service. Attempt to reverse-engineer, decompile, or access the source code of the Service. Use the Service for any unlawful purpose or to harm others. Circumvent rate limits, session enforcement, or other technical restrictions.
6. Data and Accuracy
Prevara aggregates and presents publicly available government procurement data. While we strive for accuracy, we do not guarantee that all data is complete, current, or error-free. Government source data may contain errors, delays, or omissions beyond our control. The Service is not a substitute for independent verification of procurement opportunities, compliance obligations, or contract requirements. You should verify all information with the relevant contracting agency before making business decisions.
7. Intellectual Property
The Service, including its design, features, analytics, and proprietary scoring methodologies, is owned by Prevara LLC and protected by applicable intellectual property laws. Government procurement data displayed through the Service is public domain. Our analysis, presentation, and scoring of that data is proprietary.
8. Limitation of Liability
To the maximum extent permitted by law, Prevara LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost business opportunities, arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
10. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through the Settings page. Account deletion is permanent and cannot be undone.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Alameda County, California.
12. Changes to Terms
We may update these Terms at any time by posting the revised version on this page with an updated date. Continued use of the Service after changes constitutes acceptance. For material changes, we will notify subscribers via email.
